General Terms and Conditions (GTC) of Wellody

§ 1 Scope
These General Terms and Conditions apply to all business relationships between “Wellody The Soundtrack of Your Life”, represented by Manuel Schauer (hereinafter referred to as “Service Provider”), and the customer (hereinafter referred to as “Client”), exclusively in the version valid at the time of the order.
Deviating terms and conditions of the Client are not accepted, unless Wellody expressly agrees to their validity in writing.
These GTC apply to all personalized song lyrics and songs commissioned by customers via the Wellody website.
A customer within the meaning of these GTC is any natural person who concludes a legal transaction primarily for purposes that cannot be attributed to their commercial or self-employed professional activity.
Commercial users may only use the services for private and non-commercial purposes.
§ 2 Conclusion of Contract and Scope of Services
The subject of the contract is the creation of individual, AI-generated song lyrics and songs, based on information provided by the Client.
The contract is concluded as soon as Wellody confirms the order by email.
§ 3 Delivery and Duties to Cooperate
The personalized content is delivered digitally to the email address provided by the Client.
The Client undertakes to provide correct, complete, and truthful information.
§ 4 User Behavior and Responsibilities
The Client undertakes not to provide any content that violates applicable law, copyrights, or the rights of third parties, in particular no illegal, defamatory, offensive, threatening, or obscene content.
The use of the services to create illegal or offensive content is expressly prohibited.
The Client indemnifies Wellody from all claims of third parties that may arise from the use of the services.
§ 5 Copyrights and Rights of Use
The content generated by Wellody using AI is subject to copyright protection.
The Client receives a simple, non-exclusive, non-transferable right of use for personal, non-commercial use only of the created works.
Editing, commercial use, public performance, or distribution of the content requires the express written consent of Wellody.
Wellody assumes no liability for possible similarities of the AI-generated content with existing third-party copyrighted works. Checking for possible infringements is the sole responsibility of the Client.
The Client undertakes to indemnify Wellody from any claims of third parties resulting from the use of the created content.
§ 6 Payment Terms
The amount of the fee is based on the prices valid and displayed on the website at the time of order.
Payments are made using the payment method selected by the Client during the ordering process.
§ 7 Right of Withdrawal
The Client expressly waives the right of withdrawal if they agree that the execution of the personalized service begins before the expiry of the withdrawal period.
§ 8 Warranty and Liability
The warranty is governed by statutory provisions.
Wellody is not liable for damages arising from incomplete or incorrect information provided by the Client.
§ 9 Data Protection
Personal data of the Client is processed exclusively for contract fulfillment and in accordance with the GDPR. Details can be found in Wellody’s Privacy Policy.
§ 10 Final Provisions
The law of the Federal Republic of Germany applies. Place of jurisdiction, insofar as legally permissible, is the registered office of Wellody.
The EU Commission provides a platform for online dispute resolution (ODR): http://ec.europa.eu/consumers/odr. Wellody is not obliged to participate in dispute resolution procedures before a consumer arbitration board.
